These Terms govern your use of Biddio’s marketplace. By creating an account or using the site you agree to these Terms and our Privacy Policy. Nothing in these Terms excludes rights you have under the Australian Consumer Law (ACL).
1. Key definitions
User: anyone with a Biddio account.
Seller: a user who lists items.
Buyer: a user who bids or buys.
Listing: an item or service posted on Biddio.
Auction: a time-limited sale where the highest valid bid wins (subject to reserve).
2. Eligibility & accounts
You must be 16+ to create an account. Sellers must be 18+.
Keep your details accurate and your login secure. You are responsible for activity on your account.
We may require verification (e.g., initial wallet top-up) before certain features are unlocked.
Guest access (not logged in) and feature limits
Biddio allows limited browsing for guests (not logged in). To protect users and reduce scams, certain features are restricted unless you are logged in and/or verified.
If you are not logged in (a guest), you may be able to browse listings, but you cannot:
- place bids on auctions
- use “Buy Now” (where available)
- message other users or contact sellers through the platform
- view full seller contact details or other restricted listing details
- watch/save listings or use other account features
If you are logged in but not verified, additional limits may apply, including restrictions on viewing contact details, messaging, bidding, buying, or creating listings.
We may adjust these restrictions at any time for safety, fraud prevention, or operational reasons.
3. Marketplace rules
Listings must be accurate, lawful, and in the correct category. You must have the right to sell the item.
Bidding: When you place a bid, you agree to buy the item if you win and the reserve is met.
Reserves: Some auctions have a minimum price. If the reserve is not met, the seller may choose not to sell.
Auto/Proxy bids: You can set a maximum; Biddio may auto-increase your bid in increments. You can raise your max while leading.
Ending & sniping: Auctions end at the posted time (local display). Anti-snipe or extension rules may apply as shown on the listing.
Winner obligations: Winners must pay promptly using accepted methods and communicate with the seller to arrange pickup/shipping.
Seller obligations: If reserve is met (or no reserve), the seller must complete the sale as described, within a reasonable time.
4. Fees, wallet credits & taxes
We may charge listing fees, feature fees and/or commission on successful sales; the applicable fees are shown at or before use.
Wallet credits are pre-paid amounts used for Biddio fees/features. Credits are non-transferable and generally non-refundable except as required by law or where we choose to refund.
Credits spent are non-refundable
Any Biddio credits that have been spent/used on fees, withdrawals, listing actions, features, promotions, or other in-platform services are non-refundable.
Sellers are responsible for any applicable GST and taxes on their sales.
5. Payments, shipping & disputes
Marketplace payments: Biddio does not hold buyer funds for sellers. Unless a listing states otherwise, buyers pay sellers directly and pickup/shipping is arranged between buyer and seller.
Top-ups / platform fees: Wallet top-ups and certain platform fees may be processed by third-party payment providers.
Shipping, pickup, and risk of loss are arranged between buyer and seller unless a listing states otherwise.
For problems, contact the other party first via Biddio Messages; escalate to support@biddio.com.au if needed. Chargebacks or unpaid fees may affect your account.
6. Prohibited items & conduct
You must not list, buy, or sell illegal, dangerous, counterfeit, or otherwise prohibited items. You must not:
- engage in fraud, misrepresentation, or fee avoidance;
- harass others or post unlawful content;
- misuse ratings/reviews or spam;
- attempt security breaches, scraping, or automated bulk actions.
We may remove listings, limit features, or suspend/terminate accounts for breaches.
7. User content & IP
You own the content you upload but grant Biddio a worldwide, non-exclusive, royalty-free licence to host, display, and promote your listings in connection with the marketplace.
Do not upload content you don’t have rights to. Trademarks and third-party IP must be respected.
8. Platform availability & changes
We aim to keep Biddio fast and reliable but do not guarantee uninterrupted access. Features may change or be withdrawn at any time.
9. Warranties & liability
Except as required by law (including the ACL), Biddio provides the service “as is” and excludes implied warranties. To the extent permitted by law, our liability for services is limited to re-supplying the services or paying the cost of re-supply. We are not liable for losses arising from user conduct, listings, or third-party services.
10. Account actions
We may remove content, limit features, or suspend/terminate accounts that breach these Terms, harm users, or risk legal/operational issues. You may close your account at any time (we may retain data as required by law).
11. Privacy
Our handling of personal information is set out in the Privacy Policy. By using Biddio you consent to that handling.
12. Complaints & consumer rights
Nothing in these Terms limits your rights under the Australian Consumer Law. If you have a concern, contact support@biddio.com.au. We’ll work to resolve issues promptly.
13. Governing law
These Terms are governed by the laws of Western Australia and the parties submit to the courts of WA (or as required by consumer law).
14. Changes to these Terms
We may update these Terms at any time. The updated version will apply when posted with a new “Last updated” date. Continued use means acceptance of the changes.
